Today, the Council has submitted a Court Order for Possession under CPR Part 55 to begin formal legal proceedings in relation to the current trespass incident.

This step provides a clear and enforceable legal basis for eviction, which is recognised by the police and other enforcement agencies. A court order carries more weight than a common law eviction and allows for swift enforcement by court bailiffs, if required.

Importantly, should the trespassers return, there is no need to reapply for another possession order. The existing order remains valid and enforceable, and the Council may also seek an injunction if necessary.

While the court process may take slightly longer, it is the most appropriate and legally sound approach for the Council, especially in cases involving a significant number of individuals. It also ensures that the Council is acting within the law and mitigates the risk of legal or reputational challenges that could arise from a common law eviction.

This action underscores the Council’s commitment to upholding legal standards and ensuring community safety through lawful, proportionate means.
